Paragraph 10 Existing Part B PPC permitsI1

(1)
Subject to paragraph 12, an existing Part B PPC permit which authorises an activity which is a regulated activity (within the meaning of the 2018 Regulations) has effect on or after the relevant date as if it were a permit (within the meaning of the 2018 Regulations) (“a deemed permit”).
(2)
In accordance with sub-paragraph (1)—
(a)
any condition to which an existing Part B PPC permit is subject has effect as if it were a condition attached to the deemed permit,
(b)
the operator in relation to the existing Part B PPC permit is to be treated as the authorised person in respect of the deemed permit.
