Paragraph 1 Imposition of a fixed monetary penalty or compliance noticeF4I1

England and Wales

(1)

In relation to an offence under regulation 3(1) or (2), the regulator may by notice impose—

F1(a)

a requirement to pay to the regulator a penalty of £200 (a “fixed monetary penalty”); or

(b)

a requirement to take such steps as the regulator may specify, within such period as it may specify, to secure that the offence does not continue or recur (“a compliance notice”).

(2)

Before doing so the regulator must be satisfied beyond reasonable doubt that the person has committed the offence.

(3)

A requirement under sub-paragraph (1)(a) or (b) may not be imposed on a person on more than one occasion in relation to the same act or omission.
