Regulation 39 Compliance notice

England and Wales

(1)

An enforcing authority may, by way of serving a written notice (a “compliance notice”) on the offender, require the offender to take such steps as the authority may specify, within such periods as may be specified, to secure that the act or omission giving rise to the offence does not continue or recur.

(2)

A compliance notice may not be served if a fixed monetary penalty notice has been served on the offender for the same act or omission.
