Article 7 Scrutiny procedure

If an admissible application does not meet the conditions laid down in Subsection 2 of Section 2 of Chapter I of Title II of Part II of Regulation (EU) No 1308/2013, the F1Secretary of State shall inform the F2applicant or authorities of the third country F3, where relevant, of the grounds for refusal, setting a deadline for the withdrawal or modification of the application or for the submission of comments.

If, following that information, substantial modifications are made to the product specification, F4a new version of the single document F5, where relevant, and a consolidated version of the proposed product specification F6must be submitted to the Secretary of State.

If the obstacles to the conferral of protection are not remedied by the F7applicant or third-country authorities F8... within the given deadline, the F9Secretary of State shall reject the application in accordance with Article 97(4) of Regulation (EU) No 1308/2013.

Any decision to reject the application concerned shall be taken by the F10Secretary of State on the basis of the documents and information available to F11the Secretary of State. The Secretary of State shall notify the F12applicant or the third-country authorities F13, as relevant, of the decision to reject the application.
