Rule 24.6 Determination of appealsI1
England
The provincial court will hold a hearing for the purpose of determining an appeal under this Part unless the Dean makes an order under paragraph (2).
The Dean may order that any appeal to which this Part applies is to be determined by the provincial court on consideration of written representations instead of at a hearing if the Dean considers, having regard to the overriding objective in Part 1, that it is expedient to do so.
The Dean must afford the parties an opportunity to make representations before deciding whether to make an order under paragraph (2).
Where an order is made under paragraph (2) the Dean may give directions for the purpose of determining the appeal on consideration of written representations.
The Dean or the provincial court may at any time prior to the final determination of an appeal revoke an order made under paragraph (2).
The provincial court’s determination of an appeal pursuant to an order under paragraph (2) has the same effect for all purposes as if it had been made following a hearing.
