The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated for the purposes of section 2(2) of the European Communities Act 1972f1 in relation to the common agricultural policy of the European Communityf2, acting jointly, in exercise of the powers conferred on them by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:

1Title, commencement and interpretation

(1)

These Regulations may be cited as the Farm and Conservation Grant (Amendment) Regulations 1994 and shall come into force on 30th November 1994.

(2)

In these Regulations—

(a)

“the principal Regulations” means the Farm and Conservation Grant Regulations 1991f1;

(b)

“the appropriate Minister” has the same meaning as in regulation 2(1) of the principal Regulations.

2Savings

Regulation 4 below shall not apply to—

(a)

any improvement plan approved under the principal Regulations before 30th November 1994; or

(b)

any request for the variation of such a plan or any application for approval of an improvement plan, received before that date by the appropriate Minister,

and that provision of these Regulations shall not affect the operation of the principal Regulations in relation to any such plan, request or application.

3Amendment of the principal Regulations

The principal Regulations shall be further amended in accordance with regulation 4 below.

4Amendment of the principal Regulations

In Schedule 1 (“ELIGIBLE AGRICULTURAL WORKS, FACILITIES AND TRANSACTIONS AND RATES OF GRANT”) paragraph 1(b) shall be deleted.

Explanatory note

(This note is not part of the Regulations)

These Regulations further amend the Farm and Conservation Grant Regulations 1991, as amended (“the principal Regulations”), which implement provisions in Title IV of Council Regulation (EEC) No. 2328/91 (OJ No. L218, 6.8.91, p.1) on improving the efficiency of agricultural structures.

The Regulations amend the principal Regulations, subject to a savings provision, by removing the provision for payment of grant in respect of facilities for handling, storage and treatment of agricultural effluents and waste, and related fixed disposal facilities (regulations 2 and 4).
