Regulation 7 Restriction on further applicationsI1

Where the Scottish Ministers have refused an application for felling permission (“the original application”), a further application for felling permission may not be made in relation to the same circumstances.

Where an application is made in contravention of paragraph (1), the Scottish Ministers may reject it without consideration.

Paragraphs (1) and (2) do not apply where the Scottish Ministers are satisfied that the applicant has provided further information, in response to the statement of reasons given for the refusal of the original application, such as to merit the acceptance of a further application for consideration.
