In section 4—

(a)

in subsection (2)(b), after sub-paragraph (i) insert—

“(ia)

the Welsh Ministers,”;

(b)

in subsection (9), after “in relation to” insert “the Secretary of State and”;

(c)

after subsection (9) insert—

“(9A)

In relation to the Welsh Ministers—

(a)

this section only applies to any premises falling within subsection (1) if they are situated in Wales, and

(b)

references in this section to land are references only to land situated in Wales.”;

(d)

in subsection (10)—

(i)

in paragraph (a), after “the Planning (Listed Buildings and Conservation Areas) Act 1990” insert “or the Historic Environment (Wales) Act 2023”;

(ii)

in paragraph (b), after “the Ancient Monuments and Archaeological Areas Act 1979” insert “or the Historic Environment (Wales) Act 2023”.
