Explanatory note
(This note is not part of the Order)
This Order amends the Human Rights Act 1998 to reflect the withdrawal by the UK Government of the derogation from Article 5(3) of the European Convention on Human Rights which was originally set out in Part I of Schedule 3 to that Act. The withdrawal of the derogation was effective from 26th February 2001 and followed the implementation of Schedule 8 to the Terrorism Act 2000 (2000 c. 11).
