In section 28 (proceedings) after subsection (2) insert—

“(2A)

Section 3 of the Territorial Waters Jurisdiction Act 1878 (consent of Secretary of State for certain prosecutions) does not apply to proceedings for an offence under section 25, 25A or 25B.”
