The Secretary of State and the Welsh Ministers make this Order in exercise of the powers conferred by section 2(2) of the European Communities Act 1972^f1 (“the 1972 Act”), and by section 22(5) of the Wildlife and Countryside Act 1981^f2.

The Secretary of State has been designated for the purposes of section 2(2) of the 1972 Act in relation to the environment^f3, and the Welsh Ministers have been designated for those purposes in relation to the prevention and remedy of environmental damage^f4.
