In section 40 (offences relating to authorised persons)—

(a)

in subsection (2), paragraph (a) shall be omitted; and in paragraph (b) the words “on conviction on indictment,” shall be omitted; and

(b)

in subsection (3) the words “on summary conviction” and “not exceeding level 5 on the standard scale” shall be omitted.
