Paragraph 11 Maintenance of the authorised scheme
The undertaker may at any time maintain the authorised scheme, except to the extent that this licence or an agreement made under this licence provides otherwise.
No maintenance works whose likely effects are not assessed in the environmental statement may be carried out, unless otherwise approved by the MMO.
Maintenance works include but are not limited to—
major offshore artificial nesting structure component replacement;
offshore artificial nesting structure component repairs;
painting and applying other coatings to the offshore artificial nesting structure;
bird waste and marine growth removal; and
access ladder and boat ladder replacement;
Where the MMO’s approval is required under sub-paragraph (2), approval may be given only where it has been demonstrated to the satisfaction of the MMO that the approval sought is unlikely to give rise to any materially new or materially different environmental effects from those assessed in the environmental statement.
