Section 61 Counterclaim for revocation in action for infringement.
A defendant in an action for infringement of a patent may, without presenting a petition, apply in accordance with F1rules of courtrules made under section seven of the M1Northern Ireland Act 1962 by way of counterclaim in the action for revocation of the patent.
