In section 77B (escalating penalty notices), at the end insert—

“(9)

Where the recipient of the notice is—

(a)

a trustee of an operating superfund scheme,

(b)

the responsible body of an operating superfund, or

(c)

a person responsible for a key function in relation to an operating superfund,

subsection (5)(b) has effect as though the figure mentioned there were £20,000.”
