In section 23 (securing of benefits)–

(a)

subsections (1) and (5) are omitted,

(b)

in subsection (4), for “(1) to (3)” there is substituted “ (2) and (3) ”;

and subsections (2) and (3) of that section do not apply where the winding up is begun on or after the principal appointed day F1and for the purposes of this paragraph the time when a scheme begins to be wound up shall be determined in accordance with regulation 2 of the Occupational Pension Schemes (Winding Up) Regulations 1996.
