Amend section 208 (appeals against notices under section 207) as follows.

(2)

After subsection (5) insert—

“(5A)

Subsection (5) does not apply to an appeal against a notice issued by a local planning authority in England.”

(3)

In subsection (6) for “such an appeal is brought” substitute “ an appeal is brought under subsection (1) ”.
