Paragraph 4 Effect of prohibition order on planning permissionI1

When a prohibition order takes effect, any planning permission for the mining operations or depositing of mineral waste to which the order relates ceases to have effect.

Sub-paragraph (1) does not affect planning permission for mining operations or depositing of mineral waste carried out before the prohibition order takes effect.

Sub-paragraph (1) does not limit the power of the planning authority or the Welsh Ministers, if the order is revoked, to make a further grant of planning permission for mining operations or depositing of mineral waste.
