Land in respect of which—

(a)

a compulsory purchase order is in force and the appropriate authority has power to serve, but has not served (and is not treated by virtue of any enactment as having served), a notice to treat, or

(b)

there is in force a compulsory purchase order providing for the acquisition of a right over it and the appropriate authority has power to serve, but has not served (and is not treated by virtue of any enactment as having served), a notice to treat in respect of the right.
