Paragraph 1 Circumstances in which order takes effectI1

(1)

Where a planning authority makes an order under section 102 modifying or revoking a planning permission granted by the authority (other than an order modifying a condition to which a permission is subject by virtue of section 93 or 94), the order takes effect only—

(a)

if it is confirmed by the Welsh Ministers under paragraph 2, or

(b)

in accordance with paragraph 3.

(2)

Where a planning authority makes an order under section 102—

(a)

modifying a condition to which a planning permission granted by the authority is subject by virtue of section 93 or 94, or

(b)

modifying or revoking a planning permission granted by the Welsh Ministers,

the order takes effect only if it is confirmed by the Welsh Ministers (and accordingly paragraph 3 does not apply).
