Paragraph 7 Two or more applicationsI1

(1)

This paragraph applies where a planning authority has received an application under paragraph 1.

(2)

The applicant may not make another application under paragraph 1 that is connected with that application.

(3)

If the application has been determined (whether or not it has been finally determined), no other person may make a connected application under paragraph 1.

(4)

Sub-paragraph (5) applies if, before the application has been determined, the planning authority receives a connected application under paragraph 1 from another person.

(5)

For the purposes of the determination of the applications and any appeal against their determination, this Schedule has effect—

(a)

as if they were a single application made to the planning authority on the day it received the later application;

(b)

as if references to the applicant were references to each of the applicants.

(6)

For the purposes of this paragraph—

(a)

applications in respect of pre-1948 minerals permissions are connected where they relate to the same permission;

(b)

applications in respect of post-1948 minerals permissions are connected where they relate to the same site.
