Section 361 Power to require functions to be exercised by committees, sub-committees or officersI1

England and Wales Not yet in force

Changes not yet applied. Later legislation changes this provision in ways not yet written into the text below:

(1)

Regulations may require a planning authority to make arrangements under section 101 of the Local Government Act for any of its relevant functions to be exercised by a committee, sub-committee or officer of the authority.

(2)

The regulations may specify the terms of the arrangements (which may include exceptions) and any permitted variations in those terms.

(3)

Where arrangements required by the regulations are in force in relation to a relevant function of a planning authority, the function may only be exercised in accordance with the arrangements (and section 101(4) of the Local Government Act does not apply).

(4)

In this Chapter “relevant function” means a function exercisable in relation to an application under or by virtue of this Act.
