Article 25 Power to remove goodsI1
England, Wales and Scotland
If any goods are left on or in any part of the harbour premises the Commissioners may give notice that the goods must be removed within a specified period (which must not be less than six hours)—
where reasonably practicable, to the owner of the goods in person;
otherwise, by affixing a written notice to the goods.
Upon the expiry of the notice, the Commissioners may cause the goods to be removed to a warehouse or store; and such removal shall be carried out at the expense and risk of the owner.
Notwithstanding such removal on behalf of the Commissioners, the goods shall be subject to a lien for the cost of removal, and for any charges payable to the Commissioners by the owner in respect of the goods.
The Commissioners may, if they think fit, after giving seven days’ notice to the owner of the goods, and shall if so required by the owner of the goods, sell or otherwise dispose of the goods, in such manner as they think fit and reimburse themselves out of the proceeds of sale, and the Commissioners shall hold any surplus of such proceeds on trust for the person entitled to the proceeds.
In this article, “goods” includes vehicles which are being exported or imported through the harbour.
