Regulation 14 Appeals against compliance notices

Any person who is aggrieved about a compliance notice may appeal against that notice to a sheriff.

The enforcement authority may be a party to an appeal under this regulation.

An appeal under this regulation must be made by way of summary application and must be lodged with the sheriff clerk within the period of 28 days, beginning with the day on which the compliance notice is given.

On good cause being shown, the sheriff may hear an appeal under this regulation notwithstanding that it was not lodged within the time mentioned in paragraph (3) above.

The sheriff may suspend a compliance notice pending an appeal.
