Explanatory note

(This note is not part of the Order)

This Order revokes the Price Marking (Bargain Offers) Order 1979, as amended, which, except in the cases set out in that Order, prohibits the indication of a price for the retail sale of goods or a charge for the provision of services to non-business users which includes an express or an implied statement that the price or charge is lower than another price or charge for, or a value ascribed to, goods or services of the same description.

The provisions of the revoked Order are replaced by the provisions of Part III of the Consumer Protection Act 1987 and a code of practice issued under section 25 thereof, which provisions come into force (subject to certain transitional arrangements) on the same date as this Order.
