Explanatory note

(This note is not part of the Order)

Article 2 of this Order amends the Private Security Industry Act 2001 (Designated Activities) Order 2006 (“the 2006 Order”) to remove the amendments made to that Order by the Private Security Industry Act 2001 (Designated Activities) (Amendment) Order 2006 (“the amending Order”). Consequently, the 2006 Order will, inter alia, designate all manned guarding activities set out in paragraph 2 of Schedule 2 to the Private Security Industry Act 2001 (“the 2001 Act”) for the purposes of section 3 of that Act (licensable conduct) without the exceptions which were previously made to that designation by the amending Order. Article 3 of this Order revokes the amending Order. Amendments made to Schedule 2 to the 2001 Act by the Private Security Industry Act (Amendments to Schedule 2) Order 2006f1, which will come into force on the same day as this Order does, will remove from the scope of the 2001 Act those same activities which were previously excepted from the designation by the amending Order.
