United Kingdom

(1)

~~Proceedings in respect of any offence under this Act shall not be instituted in England or Wales except—~~

(a)

~~by the Secretary of State,~~

~~by the Environment Agency, or~~

(c)

~~by or with the consent of the Director of Public Prosecutions.~~

(2)

~~Proceedings in respect of any offence under this Act shall not be instituted in Northern Ireland except—~~

(a)

~~by the head of the Department of the Environment for Northern Ireland, or~~

(b)

~~by or with the consent of the Attorney General for Northern Ireland.~~
