Regulation (EC) No 1370/2007 replaces and repeals Council Regulation (EEC) No. 1191/69 (O.J. L156, 28.6.1969, p.1) in relation to the carriage of passengers by railway. Regulation 2(2) inserts subsection (2B) into section 136. Subsection (2B) provides that subsections (2) and (2A) (which relate to the carriage of goods by railway) cease to have effect on 3rd December 2012..

Regulation 2(3) amends section 136(11) to provide that a reference to the “public service obligations regulations” is a reference to Regulation (EC) No 1370/2007 save that, before 3rd December 2012, in relation to the carriage of goods by railway, it is a reference to Council Regulation (EEC) No. 1191/69 as amended by Council Regulation (EEC) No. 1893/91.
