The Secretary of State is a Minister designated^f1 for the purposes of section 2(2) of the European Communities Act 1972^f2 in relation to measures relating to persistent organic pollutants, dangerous substances, preparations and chemicals.

These Regulations are made by the Secretary of State in exercise of the powers conferred by section 2(2) of that Act.
