Any UK additional rate in a payment reference period is determined by the calculation—

UK additional remuneration / hours of UK work

“UK additional remuneration” is any UK additional remuneration in the pay reference period determined in accordance with Part 5;

“hours of UK work” are any hours of UK workf1 in the pay reference period determined in accordance with Chapters 4 and 8 of Part 6.

“UK Work” is defined in section 4(10) of the Act as work which is carried out in the United Kingdom or its territorial waters. “Territorial waters” are to be construed in accordance with the definition of “territorial sea” in section 1 of the Territorial Sea Act 1987 (c. 49).
