Section 6 of the Psychoactive Substances Act 2016 is amended as follows.

(2)

In subsection (1)—

(a)

for “This section applies” substitute “ Subsections (2) to (10) apply ”;

(b)

in paragraph (a), after “court” insert “ in Scotland or Northern Ireland ”.

(3)

After subsection (10) insert—

“(11)

For the requirement for a court in England and Wales considering the seriousness of an offence under section 5 to treat certain matters as aggravating factors, see section 72 of the Sentencing Code.”
