in paragraph (1), for “paragraph (2)” substitute “paragraphs (2) and (2A)”;

after paragraph (2) insert—

“(2A)

The provisions of paragraph (1) shall not apply to a person in respect of whom the Secretary of State or the Commissioners for Her Majesty’s Revenue and Customs are notified that a biometric immigration document is to be issued pursuant to regulation 13 of the Immigration (Biometric Registration) Regulations 2008^f2.”.
