Article 4 The overriding objectiveI1
England and Wales
The overriding objective of these Rules is to enable the Tribunal to deal with cases justly and at proportionate cost.
The Tribunal F1must seek to give effect to the overriding objective when it—
exercises any power under these Rules; or
interprets any rule or practice direction.
Dealing with a case justly and at proportionate cost includes, so far as is practicable—
ensuring that the parties are on an equal footing;
ensuring that the case is dealt with efficiently and expeditiously;
saving expense;
dealing with the case in ways which are proportionate to the nature, importance and complexity of the issues.
The parties are required to help the Tribunal to further the overriding objective set out above.
