Subject to paragraph (2), the following are hereby revoked—
the Control of Pollution (Special Waste) Regulations 1980 M1 (“the 1980 Regulations");
the Control of Pollution (Landed Ships’ Waste) Regulations 1987 M2;
the Control of Pollution (Landed Ships’ Waste) (Amendment) Regulations 1989 M3; and
paragraphs (1) and (2) of regulation 18 of the Transfrontier Shipment of Waste Regulations 1994 M4.
Subject to paragraph (3) of this regulation, the 1980 Regulations shall continue to have effect in relation to any special waste in respect of which the consignment note (within the meaning of those Regulations) was furnished or is treated as having been furnished to the Agency, in accordance with regulation 4 of those Regulations, before the coming into force of these Regulations.
Paragraph (2) of this regulation shall not apply in relation to any special waste in respect of which consignment notes or copies of consignment notes are furnished pursuant to regulation 9 of the 1980 Regulations and after 31st August 1996 any direction made under regulation 9 of the 1980 Regulations shall have no effect.
