Paragraph 5 FeesI1
England and Wales
Where an application is made to the relevant planning authority for a discharge, a fee is to apply and must be paid to the relevant planning authority for each application.
The fee payable for each application under sub-paragraph (1) is as follows—
a fee of £2,578 for the first application for the discharge of each of the requirements 5 (detailed design approval), 7 (battery safety management), 8 (landscape and ecology management plan), 10 (drainage), 12 (construction environmental management plan), 13 (operational environmental management plan), 14 (construction traffic management plan), 18 (soil management plan) and 19 (decommissioning and restoration);
a fee of £298 for any application for the discharge of—
any other requirements not listed in paragraph (a);
any approval required by a document referred to by any requirement or a document approved pursuant to any requirement.
Where an application under sub-paragraph (1) is made and a fee payable on or after 1 April 2025, then section 18A of the Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits) (England) Regulations 2012 (as amended by the Town and Country Planning (Fees for Applications, Deemed Applications, Requests and Site Visits (England) Amendment Regulations 2023) will apply as modified by this Order, so that “the relevant amount” means the fee payable under sub paragraph (2)(a), (2)(b) or (2)(c) above.
Any fee paid under this Schedule must be refunded to the undertaker within four weeks of—
the application being rejected as invalidly made; or
the relevant planning authority failing to determine the application within the relevant period in paragraph 2(3) unless—
within that period the undertaker agrees, in writing, that the fee is to be retained by the relevant planning authority and credited in respect of a future application; or
a longer period of time for determining the application has been agreed pursuant to paragraph 2(3) of this Schedule, as applicable.
