Section 9 applies in relation to a comparable trade mark (IR) but as if—
(a)
the words in brackets in subsection (3) referring to section 40(3) were replaced with a reference to paragraph 1(6) of this Schedule; and
(b)
the proviso in subsection (3) were omitted.
