(1)
Before exercising a power listed in sub-paragraph (3), the CAA must consider whether it would be more appropriate to proceed under the Competition Act 1998.
(2)
The CAA must not exercise such a power to the extent that it considers it would be more appropriate to proceed under that Act.
(3)
Those powers are—
(a)
the power to give a contravention notice under paragraph 1;
(b)
the power to give an enforcement order under paragraph 3;
(c)
the power to give and confirm an urgent enforcement order under paragraphs 5 and 6;
(d)
the power to impose penalties under paragraphs 9 and 10.
