at the end of sub-paragraph (a) omit “or”;

after paragraph (2)(b) insert—

“; or

(c)

where a local authority notifies the Tribunal before the expiry of the time limit for submitting a response that it will not oppose the appeal in a special educational needs case.”;

after paragraph (6) insert—

“(7)

Where a local authority has notified the Tribunal before the expiry of the time limit for submitting a response that it will not oppose the appeal in a special educational needs case, the notice under paragraph (6) must state the date on which the Tribunal was so notified.”
