Article 5B Allocation of cases to the standard track or the open trackF1

Provision for the allocation of cases to the standard track or the open track is to be made by practice direction.

The Tribunal may give a direction allocating a case to a different track at any time in accordance with rule 6 (procedure for applying for and giving directions) if it considers it in the interests of justice to do so.

This rule does not apply to cases to which rule 19(1A) (transfer of cases to the Upper Tribunal) applies.
