Explanatory note

(This note is not part of the Rules)

These Rules replace the Lands Tribunal Rules 1996 (S.I. 1996/1022) as amended. They correspond closely to the Tribunal Procedure (Upper Tribunal) Rules 2008 (S.I. 2008/2698).

Part 1 (introduction) contains interpretation provisions and states the overriding objective applicable to proceedings before the Lands Chamber.

Part 2 (general powers and provisions) covers matters such as case management directions, sanctions for non-compliance, costs orders, representation and evidence.

Part 3 (applications for permission to appeal), Part 4 (appeals), Part 5 (references), Part 6 (applications under section 84 of the Law of Property Act 1925 (discharge or modification of restrictive covenants affecting land)) and Part 7 (applications under section 22 of the Rights of Light Act 1959), cover the time limits and other requirements for starting and responding to different types of proceedings heard in the Lands Chamber.

Part 8 (proceedings, including judicial review proceedings, transferred to the Tribunal) provides for the giving of directions in the event that proceedings that started elsewhere are transferred to the Lands Chamber.

Part 9 (hearings) provides for the manner in which hearings are notified and conducted.

Part 10 (decisions) provides for the manner in which decisions of the Lands Chamber are given and notified.

Part 11 (correcting, setting aside, reviewing and appealing decisions of the Tribunal) relates to certain post-hearing decisions that the Lands Chamber may make in consequence of its main decision on a case.
