Section 43A (representations where restriction direction not given) is amended as follows.

For subsection (8) substitute—

“(8)

The managers of the relevant hospital must, so far as the managers consider it appropriate to do so, provide the information to the person or the provider of probation services.”

After subsection (8) insert—

“(8A)

If the provider of probation services is provided with information under subsection (8), it must provide the information to the person.”
