Regulation 2 InterpretationI1

In these Regulations—

• “the Act” means the Energy Act 2010;

• “Bank of England base rate” means—

  1. (a)

     the rate announced from time to time by the Monetary Policy Committee of the Bank of England as the official dealing rate, being the rate at which the Bank is willing to enter into transactions for providing short term liquidity in the money markets; or

  2. (b)

     where an order under section 19 of the Bank of England Act 1998^f1 is in force, any equivalent rate determined by the Treasury under that section;

• “market share”, in relation to a scheme electricity supplier and a scheme year, means—

  1. (a)

     F1unless regulation 11 applies, the market share of the supplier, expressed as a percentage—

     1. (i)

        as notified by the Authority to the Operator under regulation 4(1)(b); or

     2. (ii)

        where the Authority is the Operator, as determined under regulation 4(2A); or

  2. (b)

     if regulation 11 applies, the market share of the supplier, expressed as a percentage, as recalculated by the Operator under regulation 11(6);

• F2“the Operator” means—

  1. (a)

     in relation to scheme years 1 to 6, the person for the time being appointed by the Secretary of State under regulation 3; and

  2. (b)

     in relation to F3scheme years 7 to 11, the Authority;

• “the Scheme Regulations” means the Warm Home Discount Regulations 2011^f2;

• “working day” means any day other than a Saturday or Sunday or a day which is a bank holiday or public holiday in England and Wales or in Scotland.

In these Regulations the following expressions have the same meaning as in the Scheme Regulations—

• “core group customer”

• “domestic customer”

• “group of companies”

• “the prescribed rebate”

• “scheme electricity supplier”

• “scheme gas supplier”

• “scheme year” (and “scheme year” followed by a number).
