If the meter on being tested is proved to register incorrectly to any degree exceeding F4five per cent the relevant percentage—
the meter shall be deemed to have registered incorrectly to that degree since the last occasion but one before the date of the test on which a reading of the index of the meter was taken by F5Scottish Water , unless it is proved to have begun to register incorrectly on some later date; and
the amount of any refund to be made to, or of any extra payment to be made by, the consumer shall be paid or allowed by Scottish Water or paid by the consumer, as the case may be, F6.
In subsection (3), “the relevant percentage” means—
in the case of a high flow rate, 2.5%,
in the case of a low flow rate, 6%.
The Scottish Ministers, by regulations—
must define “high flow rate” and “low flow rate” for the purpose of subsection (4),
may amend a percentage figure appearing in subsection (4).
