Paragraph Definition of waste
For the purposes of the second paragraph of the preceding section of this Schedule (Specified purpose or manner of use), “waste” shall be construed in accordance with section 75 of the Environmental Protection Act 1990 M1, provided that “waste” shall include any waste disposed of for reprocessing or recycling purposes but shall not include any radioactive waste as defined in F1paragraph 5 of schedule 8 of the Environmental Authorisations (Scotland) Regulations 2018 F2Schedule 23 to F3the Environmental Permitting (England and Wales) Regulations 2016.
