(1)

The provisions of this Schedule, unless otherwise agreed in writing between the undertaker and the Tees Port Authority, have effect for the protection of the Tees Port Authority.

(2)

For the purposes of this Schedule, the definition of “tidal work” is taken to include—

(a)

any projection over the river by booms, cranes and similar plant or machinery; and

(b)

any authorised development or operation or activity authorised by this Order which affects the river or any functions of the Tees Port Authority as harbour authority or which is carried out within the relevant TPA limits of jurisdiction.
