Regulation 12 Giving of a building notice or an application for building control approvalF16E1

This regulation applies to a person who intends to—

Subject to the following provisions of this regulation, a person to whom this regulation applies shall—

A person intending to carry out building work in relation to a building to which the Regulatory Reform (Fire Safety) Order 2005 M1 applies, or will apply after the completion of the building work, shall F3give an application for building control approval with full plans.

A person intending to carry out building work which includes the erection of a building fronting onto a private street shall F4give an application for building control approval with full plans.

A person intending to carry out building work in relation to which paragraph H4 of Schedule 1 imposes a requirement shall F5give an application for building control approval with full plans.

A person intending to carry out building work is not required to give a building notice or F6an application for building control approval with full plans where the work consists only of work—

A person intending to carry out building work in relation to which Part P of Schedule 1 imposes a requirement is required to give a building notice or F10an application for building control approval with full plans where the work consists of—

Where F11regulation 22 of the Building (Registered Building Control Approvers etc.) (England) Regulations 2024 (local authority powers in relation to partly completed work) applies, the owner shall comply with the requirements of that regulation instead of with this regulation.

Where—

the person shall give a building notice to the F12relevant authority as soon as reasonably practicable after commencement of the work.

In this regulation—

• “fronting” has the meaning given in section 203(3) of the Highways Act 1980M2; F13...

• “private street” has the meaning given in section 203(2) of the Highways Act 1980M3F14... F15; and

• “special location” means—

  1. (a)

     within a room containing a bath or shower, the space surrounding a bath tap or shower head, where the space extends—

     1. (i)

        vertically from the finished floor level to—

     2. (aa)

        a height of 2.25 metres; or

     3. (bb)

        the position of the shower head where it is attached to a wall or ceiling at a point higher than 2.25 metres from that level; and

     4. (ii)

        horizontally—

     5. (aa)

        where there is a bath tub or shower tray, from the edge of the bath tub or shower tray to a distance of 0.6 metres; or

     6. (bb)

        where there is no bath tub or shower tray, from the centre point of the shower head where it is attached to the wall or ceiling to a distance of 1.2 metres; or

  2. (b)

     a room containing a swimming pool or sauna heater.
