Regulation 18 Exclusion of activities which are directly exposed to competitionI1

These Regulations do not apply to the procurement for the award of a concession contract by a utility if the contract is intended to enable an activity referred to in regulation 32 (activities directly exposed to competition) of the Utilities Contracts (Scotland) Regulations 2016^f1 to be carried out and that activity is or is established to be directly exposed to competition in accordance with that regulation.
