As soon as a custody and community prisoner has served three-quarters of the prisoner's custody and community sentence, the Scottish Ministers must release the prisoner on community licence.
(2)
Subsection (1) does not apply in relation to a prisoner whose licence has been revoked by virtue of section 37(1) or (4).
