The Secretary of State has consulted the Gas and Electricity Markets Authority in accordance with paragraph 3(1) of Schedule 5B to the Electricity Act 1989f1.
In exercise of the powers conferred by sections 19(3A), 60(3) and 64(1) of, and Schedule 5B to, the Electricity Act 1989f2, the Secretary of State makes the following Regulations:

Section 19 was amended by the Utilities Act 2000 (c. 27), section 46 and by the Infrastructure Act 2015, section 52. The definition of “prescribed” in section 64(1) was amended by the Utilities Act 2000, Schedule 6, Part II, paragraph 38(6); there are other amendments to section 64(1) which are not relevant.
