Section 8 Periodical review of housing needs.C1C2C3C4C5C6C7C8
England and Wales
Every local housing authority shall consider housing conditions in their district and the needs of the district with respect to the provision of further housing accommodation.
Every—
combined authority,
CCA, and
two-tier county council that is a strategic authority,
must consider housing conditions in its area and the needs of its area with respect to the provision of further housing accommodation.
But if a local housing authority has complied with the duty imposed by subsection (1) in relation to a part of the area of a combined authority, CCA or two-tier county council, that strategic authority—
does not need to comply with the duty imposed by subsection (1A) in relation to that part of its area; and
may rely on the local housing authority’s consideration of the matters referred to in subsection (1) as if it were the strategic authority’s own consideration of those matters.
For F2the purpose of subsection (1) or (1A), a local housing authority or combined authority, CCA or county council shall review any information which has been brought to their notice, including in particular information brought to their notice as a result of F3the consideration of the housing conditions in their district under F4section 3 of the Housing Act 2004.
In the case of a local housing authority in England, F6or a combined authority, CCA or county council, the duty under subsection (1) includes a duty to consider the needs of people residing in or resorting to their district F7, or area, with respect to the provision of—
sites on which caravans can be stationed, or
places on inland waterways where houseboats can be moored.
In subsection (3)—
“caravan” has the meaning given by section 29 of the Caravan Sites and Control of Development Act 1960;
“houseboat” means a boat or similar structure designed or adapted for use as a place to live.
